Proposition 37: A $25 Billion Homebuyer Loan Plan—Who Qualifies?
A new second-mortgage program would help eligible buyers of certain new homes, with borrowers repaying the bonds.

California home prices can make a down payment feel like a second mortgage all by itself. Proposition 37 actually proposes a second mortgage, designed to help eligible middle-income buyers purchase certain new homes.

The California Housing Finance Agency could issue up to $25 billion in revenue bonds to finance loans covering up to 17% of an eligible home's purchase price. Buyers would still need to put down at least 3%, qualify for the program and repay the assistance loan. This isn't a free house or a giveaway.

Who Could Use the Program?

Applicants would need to have lived in California for at least one year, earn no more than twice the area's median household income for a comparable household and occupy the home. The home must meet price limits and generally be newly constructed or a qualifying first sale of converted nonresidential property.

A buyer of an existing resale house wouldn't automatically qualify. And a household in Vista or San Marcos would still have to meet the income, property and financing rules.

Who Pays Back $25 Billion?

The measure uses revenue bonds, not the usual bonds paid back from California's General Fund. Homeowners' mortgage payments would repay bond investors and cover administration.

The Legislative Analyst estimates no direct state or local government cost. That doesn't guarantee every borrower a cheaper mortgage, or that all $25 billion would be issued. Investor demand, interest rates and housing supply would matter.

There's Also a Builder Provision

Developers could choose additional labor standards in exchange for different rules governing certain construction-defect claims. That's a separate part of the measure worth noticing, even if you're mainly interested in the loan program.

Supporters argue more financing could help qualified households buy homes and encourage construction. Critics question whether a new loan program would meaningfully improve affordability, especially if eligible housing remains expensive.

What Does Yes or No Mean?

A Yes vote would authorize the new loan program and up to $25 billion in revenue bonds. A No vote would leave this particular program unauthorized; existing homebuyer assistance programs would remain.

Questions You May Have About Proposition 37

Would everyone receive 17% of a home's price?

No. The program would provide qualifying loans of up to 17%, subject to eligibility and program terms.

Would taxpayers directly repay the bonds?

The official analysis says the bonds are designed to be repaid from homeowners' payments, with no direct state or local cost.

Can I use it for any home?

No. It is limited to qualifying new homes or specified converted properties.

Is the assistance free money?

No. It is a loan that borrowers must repay.
